Promotion Description

The Young Living Global Leadership Cruise 2017 Promotion (the “Promotion”) is sponsored by Young Living Essential Oils LC, Thanksgiving Point Business Park, 3125 Executive Parkway, Lehi, UT 84043 (“Young Living”). The promotion period begins July 1, 2016, at 12:01a.m., MT, and ends at 11:59 p.m., MT, on October 31, 2016 (the “Promotion Period”). Young Living’s method of timekeeping is the official time clock for the Promotion and is final and undisputable. Winners will be selected after the Promotion Period, based on the number of Global Leadership Cruise points (“GLC Points”), the geographic location, and the membership rank of each eligible Young Living member (“Member”). Ranking is based on the ranking system outlined in the Young Living Compensation Plan and on each Member’s highest-paid rank as of May 2016.

Eligibility

The Promotion is open to active Members who are in good standing with Young Living, who have achieved the rank of Executive, are 18 years of age or older as of July 1, 2016, globally (or the majority age in their jurisdiction), and who have a primary billing address (listed on their Member account) and proof of citizenship in the United States of America, Australia, Canada (excluding Quebec), Europe, Hong Kong, Japan, Malaysia, Mexico, or Singapore. This promotion shall exclude all Members in NFR markets. Void where prohibited. Active members are Members who have made a purchase of at least 50 PV in the last 12 months and signed the Young Living Member Agreement. Star and Senior Star ranking members will only be eligible to participate as of the first day of the month after the first month (during the Promotional Period) in which they achieve the rank of Executive.

In order to receive a Prize, each winning Member must register for a ticket on the Norwegian cruise liner traveling from Tampa, Florida to the Caribbean/Central America in the spring of 2017, (“GL Cruise”) by responding to the registration link sent to their email on January 4, 2017, as outlined below.

How to Earn Points and Win

Promotion participants earn GLC Points during the Promotion Period as follows:
Essential Rewards.
Members earn GLC Points by increasing their organizational group volume (OGV) from Essential Rewards orders. Essential Rewards orders are products ordered via Young Living’s Essential Rewards (ER) program. A Members’ ER OGV is the organizational group volume coming from ER orders. For the Promotion, only ER OGV in the Members first five levels deep (“Qualifying ER OGV”) qualify for GLC Points. Members receive 15 GLC Points for every 150 Qualifying ER OGV increase over their Qualifying ER OGV of the prior month. Member Qualifying ER OGV is assigned a baseline value of their Qualifying ER OGV for the month of May 2016. Any Qualifying ER OGV during the Promotional Period below this baseline value will be replaced with the baseline value. Thus, for example, if a Member has 150 Qualifying ER OGV in June, 600 Qualifying OGV in July, 100 Qualifying ER OGV in August, and 1500 Qualifying ER OGV in September, then the Member will receive 45 GLC Points in July (600 – 150/150= 3, 3*15=45), zero GLC Points in August, and 135 GLC Points (1500-150/150=9, 9*15=135) in September. (Note that the 100 Qualifying ER OGV value in the example is replaced with the baseline value from June of 150.)
Premium Starter Kit Sales.
When a downline member who a Member personally enrolls during the Promotion Period purchases a Qualifying Premium Starter Kit (defined below), the Member will earn 10 GLC Points. GLC Points are not earned on any Qualifying Premium Starter Kit purchases of members the Member did not personally enroll during the Promotion Period. GLC Points will only be awarded for the purchase of one Qualifying Premium Starter Kits per personally enrolled downline member during that downline member’s first month of enrollment and which must be during the Promotional Period. Monthly Promotions
On or before the first day of each month of the Promotion Period, Young Living will announce a monthly promotion in which Members may earn additional GLC points during that month. Each such monthly promotion will begin on the first day of the month at 12 a.m., MT, and ends at least by 11:59 p.m., MT, on the last day of the month unless an earlier day and time is specified in the Monthly Promotion Official Rules. Each such set of Monthly Promotion Official Rules will be deemed to be incorporated into these Official Rules as an amendment thereto.

Prizes will be awarded to Members based on the following qualifications:
Top 3 Prize
The three Members with the highest GLC Point totals during the entire Promotion Period and who accept the trip (as outlined below) will receive the Top 3 Bonus Prize. The winners of the Top 3 Prize may also qualify and win a Tier 1, Tier 2, or Tier 3 prize.
Tier 1 Prize
The Tier 1 Prizes will be awarded to the Members with the highest GLC Point total during the entire Promotion Period from each of the groups shown in the following table who accept the trip. The number of Tier 1 Prizes for awarded in each group are also included in the table.
Tier 2
The Tier 2 Prizes will be awarded to the Members with the highest GLC Point total during the entire Promotion Period from each of the groups shown in the following table who accept the trip. The number of Tier 2 Prizes for awarded in each group are also included in the table. Members qualifying for the Tier 1 Prize are not qualified for the Tier 2 Prize.
Tier 3
The Tier 3 Prizes will be awarded to the Members with the highest GLC Point total during the entire Promotion Period from each of the groups shown in the following table who accept the trip. The number of Tier 3 Prizes for awarded in each group are also included in the table. Members qualifying for the Tier 1 Prize or theTier 2 Prize are not qualified for the Tier 3 Prize.
Points Calculation: GLC Points earned are calculated and updated on a monthly basis (estimated to be on or about the 20th of each month) and reflected on the Point Standings page in Virtual Office.
Points Earned: GLC Points earned may be used toward the global incentive promotion.
Point Transfers: Members may not transfer their GLC Points to another person.
Point Expiration: All GLC Points expire after the Promotion Period has ended. GLC Points cannot be redeemed for any other Young Living event, program, or product.
Point Value: GLC Points have no cash value and cannot be redeemed or refunded as such.
Backdating: GLC Points earned through backdating will be handled on a case-by-case basis.
Returns & Exchanges: Any product returns or exchanges may result in the corresponding GLC Points being forfeited. Product exchanges may affect the GLC Points value for the underlying purchase depending on how the exchange affects the PV or OGV.

Prizes

The following are the prizes to be awarded to winners of the Promotion(collectively, “Prizes”, each a “Prize”):
Top 3 Prize: This bonus prize includes a lodging upgrade for the GL Cruise to a 2-bedroom Mini Suite w/large balcony and an Adventure VIP Excursion for two with the founders during the GL Cruise. Each Top 3 Prize has an approximate retail value (“ARV”) of $2,000 USD.
- Tier One Prize: This prize includes two round-trip, first-class airline tickets from the international airport nearest the winner’s home to Tampa, Florida, one balcony-ocean view cabin Penthouse suite w/large balcony on the GL Cruise for two, and a VIP excursion for two during the GL Cruise. Additionally, Each Tier One Prize has an approximate retail value (“ARV”) of $9,500 USD.
- Tier Two Prizes: This prize includes two round-trip, economy-class airline tickets from the international airport nearest the winner’s home to Tampa, Florida and one ocean view Balcony cabin on the GL Cruise for two. Each Tier Two Prize has an ARV of $4,600 USD.
- Tier Three Prizes: This prize includes two round-trip, economy-class airline tickets from the international airport nearest the winner’s home to Tampa, Florida and one standard cabin on the GL Cruise for two. Each Tier Three Prize has an ARV of $3,100 USD.
General Prize Conditions
Young Living is not responsible for and the winners will not receive the difference, if any, between the actual value of a Prize at the time of award and the ARV stated in these Official Rules or in any Promotion-related correspondence or materials. All federal, state, and local taxes (including income and withholding taxes), if any, as well as any other costs and expenses associated with Prize acceptance and use not specified herein as being provided are the winner’s responsibility, regardless of whether the Prize is used in whole or in part. In no event will Young Living be responsible for awarding more than the Prizes stated herein. “All-expense-paid” for this Promotion, if applicable, will be limited to travel, lodging, and gift card allowances provided to the winner by Young Living in Young Living’s sole discretion. In the event there are not enough eligible Members to award all Prizes, Young Living reserves the right to only award the number of Prizes as there are eligible Members. Any Prizes not awarded after the Promotion Period may remain unawarded. Prize restrictions/conditions stated herein are not all-inclusive. Prizes are not transferrable or redeemable for cash, except that Young Living reserves the right, at Young Living's sole discretion, to substitute a prize (or portion thereof) for a prize of greater or equal value. Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Any and all guarantees and warranties on a prize are subject to the Norwegian Cruise Lines terms and conditions, and winner agrees to look solely to Norwegian Cruise Lines for any such warranty or guarantee claim.

All expenses not stated herein as part of a Prize are the Prize winner’s sole responsibility. A Prize will be forfeited if: 1) the winner is not available to travel on the dates specified for the GCL Cruise; or 2) the winner and/or his/her travel companion, if applicable, does not have the required travel documents by the date scheduled for the trip. Each winner and his/her guest are solely responsible for obtaining any travel insurance (and all other forms of insurance) that they may wish to obtain at their own expense and hereby acknowledge that Young Living has not and will not obtain or provide travel insurance or any other form of insurance. Winners are bound by the terms and conditions of all airlines, Norwegian Cruise Lines, and other third-party service providers used in connection with the Prizes. Young Living is not responsible if tickets, etc. are lost, stolen, or misplaced by a Prize winner or guest and will not be replaced or re-booked if transportation is missed for any reason. Exact dates and locations are subject to change, and are at the sole discretion of Young Living.

Prize winners and their travel companions must travel together on the same itinerary and possess all required travel documents. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Prize winners will not receive cash or any other form of compensation if actual travel costs are less than the ARVs stated in these Official Rules.

Young Living shall not be responsible for any cancellations, delays, diversions, or substitution or any act or omissions whatsoever by the air carriers, cruise ship operators, or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Young Living.

During the Promotion Period, the 300 participants with the highest GLC Point totals may be audited on a regular basis to monitor compliance with the Young Living Policies and Procedures applicable to the Member’s jurisdiction (“Young Living’s Policies and Procedures”), especially, but not limited to, those sections pertaining to advertising and promotions. Any violation of Young Living’s Policies and Procedures will disqualify the participant from the Promotion in its entirety.

Notification/Prize Acceptance

Member participants will have access to a detailed breakdown of their point totals through Virtual Office. Prize winners will be selected following the conclusion of the Promotion Period, on or before January 4, 2017. A list of Prize winners will be available on Virtual Office (YoungLiving.org) once the winners have been selected and GLC Points have been totaled and verified following the conclusion of the Promotion Period.

On or about Wednesday, January 4, 2017, an email will be sent to the Members who qualify for the Prizes.Acceptance emails will be sent to the email address on file on the qualifying Member. This email will contain an acceptance link where you must accept or decline the reward and complete a registration form by 12:00 PM (MT) on Thursday, January 5, 2017. Failure to respond to the acceptance email through the acceptance link within by this time will be deemed a declination of the trip. This declination is non-reversible and similarly acceptance of a Prize will be final. If a member declines the trip they will no longer qualify for any Prize and the Prize will be offered to the next qualifying Member for that Prize.

Travel

Travel arrangements for Prizes will be arranged for the qualifying consultant through Young Living’s preferred travel agent. If a Prize winner purchases their own airline tickets, without prior approval from Young Living’s preferred travel agent, they will be ineligible for reimbursement.

All travel arrangements must be finalized and booked at least four weeks prior to the start of the GL Cruise. A Member’s failure to respond to emails and phone calls from Young Living’s preferred travel agent within 24-hours could result in a forfeit the airfare portion of the Prize. All flight arrangements associated with the Prizes, once ticketed, are final and winning Members are responsible for any and all fees associated with changing travel in any way. Travel costs incurred between a winning Member’s home and the airport are at the Member’s expense. Luggage fees and other expenses are also solely the responsibility of the winning Member.

All personal expenses (including a drink package) incurred on the GL Cruise are the responsibility of the winning Member. Upon boarding the cruise ship, winning Members will be required to provide their own personal credit card or debit card to cover their own incidental expenses. Inquiries regarding specifics on daily funds held for incidentals by the cruise line should be directed to the cruise line. Incidentals are not included with in the Prizes for the Promotion.

Monthly Promotions

During the Promotion Period, Young Living will award additional prizes and opportunities to earn additional points each month. Monthly prizes will be announced and added to these Official Rules 5 days prior to the beginning of each month during the Promotion Period.

Each month we will have 2 qualifiers, one from each category (US/CAN & International). To qualify for a prize, the members must have the most points for a certain criteria each month.

July: Top member with most PSK Enrollments for the month of July. The prize will be 1 Rainstone Diffuser. Along with, one Essential oil of their choosing (up to $50 wholesale). (Total ARV: $300)

August: The most points from personal rank advancements and downline rank advancements for the month for the month of August. Prize: One Young Living Branded Mini I-Pad. (Total ARV: $399)

September: The member with the most GLC points earned for the month of September. Prize: One free Twelve Oils of Ancient Scriptures collection. (Total ARV: $295.39)

October: The member with the most reactivations. Prize: One free Aroma Complete. (Total ARV: $1888.81)

Cancellation and Refunds; Force Majeure
Prize winners who cancel their attendance on the GLC Cruise will not receive a refund for the value of their Prizes. Members who cancel their attendance may be required by Young Living, in its sole discretion, to reimburse Young Living for any costs associated with cancelling their trip. Young Living will not compensate, in cash or kind, qualifiers who are unable to participate in the trip after accepting the trip. Travel insurance is available through Destinations Travel and must be purchased by the winning Member at their own expense. Young Living will not be held responsible if cancellation of the event occurs due to any of the following: extreme weather, natural disasters, strikes, picket lines, boycott efforts, fires, floods, accidents, war (whether or not declared), revolution, riots, insurrections, acts of God, acts of government (including, without limitation, any agency or department of the United States of America), acts of the public enemy, scarcity or rationing of gasoline or other fuel or vital products, inability to obtain materials or labor, or other causes that are reasonably beyond the control of Young Living. In the case of such events, Young Living may provide a cash prize of equivalent value at its sole discretion.
License
By accepting a Prize, the respective winner consents to the use of his/her name, address (city and state/province of residence), voice, and statements relating to the Promotion and Young Living, and photographs or other likeness, without further compensation, notification or permission in any publicity or advertising carried out by Young Living or any related entities in any media without territorial or time limitation, except where prohibited by law.
Limitations of Liability

Young Living and its affiliates, subsidiaries, parent companies, advertising and promotion agencies, printers, and judges involved in this promotion are not responsible for any inaccuracies in information which may be used in the promotion, for any technical or human error which may occur in the processing of entries, including data entered by entrants, any entry miscommunications such as technical failures related to computer, telephone, cable, and unavailable network or server connections, related technical failures, or other failures related to hardware, software, or virus, or incomplete, late, or misdirected entries. Any compromise to the fair and proper conduct of this promotion related to a computer virus or similar type of technical impairment that may affect the proper fairness, security, and administration of the promotion may result in the termination, amendment, or modification of the promotion or portion thereof at the sole discretion of Young Living. Young Living reserves the right, in its sole discretion, to void any entries of entrants whom Young Living believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this promotion or who acts in a non-sportsmanlike manner or with the intent to threaten or harass any other person.

By participating in the Promotion, participants waive all rights to claim punitive, incidental and consequential damages, attorneys’ fees, or any damages other than actual out-of-pocket costs or losses that may arise in connection with participation in the promotion or acceptance, possession, and use of any prize.

All causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action. Some jurisdictions may not allow certain limitations on damages or the ability to seek damages through a class action, so some of these restrictions may not apply to you.

Other Rules and Regulations

If aspects of the Prizes change that are beyond the control of Young Living, neither Young Living, nor any other promotional partners furnishing Prizes, will be liable or responsible for any such changes and Young Living reserves the right to substitute a prize of equivalent or greater value, at Young Living's sole and absolute discretion, if, for any reason, all or any portion of a Prize, as described herein, are or become unavailable. No transfer of a Prize to a third party is permitted. By accepting a Prize, Prize winners agree that Young Living shall not be liable for any injuries, damages, or losses of any kind resulting from or in connection with the awarding, acceptance, possession, or use of the Prize or any aspects or parts thereof.

Young Living will be the final arbiter of all rule interpretations and qualification determinations and such decisions will be final. Where applicable, Prizes will be reported as income on the winners’ annual tax form. Prize winners will be responsible for paying all taxes on any Prizes and/or subsidy or subsidies granted by Young Living. Prize winners residing in the United States of America or Canada will be issued a respective Form 1099 or T4A reporting the fair market value of their prize as taxable income. Young Living reserves the right to suspend or terminate this Promotion, without notice, for any reason or no reason, in its sole discretion. Employees of Young Living and its associated entities and their spouses and immediate family members are not eligible to participate in this Promotion. This Promotion is void where prohibited by law. All Members who qualify will be subject to auditing or verification of their GLF Point totals.

By participating in the Promotion, you (i) acknowledge compliance with these Promotion Rules including all eligibility requirements, (ii) warrant that any information you provide in connection with this Promotion is true and accurate, and (iii) agree to be bound by the decisions of Young Living which shall be final and binding in all matters relating to this Promotion. Members who have not complied with these Promotion Rules are subject to disqualification.

This Promotion is subject to all applicable federal, state, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Promotion Rules, or the rights and obligations of participant and Young Living in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Utah without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the Federal, state and local courts of Utah.

In the event of any conflict with any Promotion details contained in these Official Rules and Promotion details contained in other Promotion materials (including, without limitation, any point of sale, online or print advertising), the details of the Promotion as set forth in these Official Rules shall prevail.

Young Living’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
