2017 YL HK Slique in 60 Challenge


The Slique in 60 Body Transformation Contest Official Rules (“these Rules”)
Unless otherwise stated, terms defined in the Policies and Procedures of Young Living Hong Kong Limited (“Young Living”), 6/F, The Wellington, 198 Wellington Street, Central, Hong Kong, shall have the same meanings when used in these Rules.
In these Rules,
(a) the “Participant” shall mean the Active Member who is eligible to enter the Contest, complete the registration progress and continue to participate in the Contest until the expiration of the Contest Period in accordance with these Rules, and “Participants” shall be construed accordingly;
(b) the “Prize” shall mean any of the prizes offered by Young Living in the Contest, and the “Prizes” shall be construed accordingly;
(c) the “Winner” shall mean any of the winner of the Grand Prize, and the “Winners” shall be construed accordingly.
Contest Description

The Slique in 60 Body Transformation Contest (the “Contest”) is offered by Young Living. The contest period begins on June 27, 2017, at 12:00 a.m., HKT, and ends at 11:59 p.m., HKT, on August 25, 2017 (the “Contest Period”).Registration for the 60-day challenge ends at 11:59 p.m June 26, 2017. Young Living’s method of timekeeping is the official time clock for the Contest and is final and undisputable. By participating in the Contest, each Participant agrees to abide by and be bound by the terms and conditions of the Contest. The Participants further agree to abide by and be bound by all decisions of Young Living which shall be final and binding, without right of appeal, in all matters relating to this Contest and award(s) including without limitation eligibility and/or disqualification of entries. The Participants participate by registering for the Contest, purchasing any one of the Slique Kits (21773 Slique Complete, 21771 Slique Advanced and 21772 Slique Assist) from Young Living Hong Kong upon registration and again for the following month, namely July, during the Contest Period, and submitting their results at the end of the Contest, as stipulated in more details below.

Eligibility

The Contest is only open to the Active Members who are in good standing with Young Living, are legal residents of Hong Kong and are 18 years of age or older as of the start of the Contest Period. “Active Members” are Members who have made a purchase of at least fifty (50) Personal Volume (PV) in the last twelve (12) months and have signed the Member Agreement. This Contest shall exclude all Members in not-for-resale (NFR) markets.

Employees of Young Living and its associated entities and their spouses and immediate family members are not eligible to participate in the Contest.

Any entry is void where prohibited.

How to Qualify for and Win Prizes & Prize Specifics

Each Participant must register for the Contest by going online to http://woobox.com/fqag2j , completing the registration form and purchasing at least one Slique® weight management kits (21773 Slique Complete, 21771 Slique Advanced and 21772 Slique Assist) from Young Living Hong Kong before the commencement of the Contest and again for the following month, namely July, during the Contest Period. Failing which his/her right to continue participating in the Contest or receiving any of the Prizes will cease forthwith.

The registration form will require the Participant to submit inter alia his/her “before photo”, starting weight and body measurements, and date of birth. The body measurements will include measurements of the Participant’s unclothed waist, hips, chest, neck, biceps, calves, and quads. The body measurements must be taken, as accurately as possible, around the body locations shown in the Body Measurement Diagram below. Any Participant who has provided false information will result in disqualification of his/her right to continue participating in the Contest or receiving any of the Prizes. Additionally, the Participants must declare their goals and target body transformation score. (“Declared Goals”).

Within 3 days of the end of the Contest (on or before 29 August 2017 11:59pm) , the Participant must go online to the result webpage and enter the complete results information requested (e.g., an “after photo,” end weight, final measurement), including a declaration of completion of his/her Declared Goals and body transformation score. Any Participant who has provided false declaration will result in disqualification of his/her right to continue participating in the Contest or receiving any of the Prizes.

For the purpose of the Contest, a Participant will be given a body change score, which will be calculated with reference to the amount of such Participant’s decrease in body measurements (in inches) and body weight (in pounds) over the Contest Period. Specifically, the body transformation score of each Participant will be calculated based on the following formula (the “Body Transformation Score”):

Body Transformation Score =
(inches lost around the waist + inches lost around the hips + inches lost around the neck + inches lost around the chest + inches lost around the biceps* + inches lost around the calf* + inches lost around the quads* + total pounds lost) divided by starting weight (pounds).
*Bicep, calf, and quad measurements will be taken from only the Right arm/leg, respectively. Beginning and ending measurements must come from the same arm/leg.
Participation Prize
Each Participant who enters his/her results at the end of the Contest will get:
-10% off their next purchase of any Slique products (in addition to the 10% / 15% discount already offered on Slique collections)

Goal Achiever Prize
Individuals who set and achieve their personal goals (target body transformation score) and indicate in their submitted results will get a Young Living Special Edition Yoga Mat (valued at HKD$698).
Inspiring story prize:
Top 3 Participants with the best essays or stories about how the Contest has changed their life, as solely determined by Young Living, will get HKD$2000 worth of Young Living’s products.
Grand Prize:
The Winners*from each of the age/sex groups listed below, who shall be Participants who are qualified for the Participation Prize and with the highest Body Transformation Score based on total inches and pounds lost, will be awarded the following (the “Grand Prize”):

*For the Contest, one male and one female Winner for each of the three age groups. For Buddy Team, the team (regardless of sex/age) with the highest body transformation score will win.
Sex is based on biological sex indicated on the Participant’s birth certificate.
General Prize Conditions
Award Conditions

Awards must be accepted as offered and may not be substituted, transferred or redeemed for cash or otherwise, except at Young Living’s sole discretion. Value of any of the Prizes is just an approximation and may differ, and Young Living will not in any event be responsible for any difference between the value stated in these Rules or in any Contest-related correspondence or materials and the actual value. Young Living reserves the right, at its sole discretion, to substitute an award of greater or equivalent monetary value (such value as solely determined by Young Living to have satisfied this condition) if the award cannot be offered as described for any reason.

In no event will Young Living be responsible for awarding more than the Prizes. In the event there are not enough Participants to award all Prizes, Young Living reserves the right to only award the number of Prizes as there are eligible Participants. Any Prize not awarded after the Contest for any reason, including without limitation of the disqualification of any of the Winners, may be cancelled by Young Living at its sole discretion. The Prizes are not transferrable or redeemable for cash, except that Young Living reserves the right, at Young Living's sole discretion, to substitute a Prize (or portion thereof) for a Prize of greater or equal value (such value as solely determined by Young Living to have satisfied this condition). The Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, whether express or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose.

During the Contest Period, the Participants with the highest Body Transformation Scores may be audited on a regular basis to monitor compliance with these Rules. Any violation of these Rules by a Participant will disqualify such Participant from the Contest in its entirety.

Prize restrictions/conditions stated herein are not meant to be exhaustive and Young Living shall have the right to amend or vary such restrictions/conditions at its sole discretion.
Notification/Prize Acceptance
Each Participant may, at Young Living’s sole discretion, have access to a detailed breakdown of his/her total points through the Virtual Office. The Winners, if any, will be determined following the conclusion of the Contest Period on or before [04/09/17], and a list of suchWinners may be available on the Virtual Office once the result are available and verified following the conclusion of the Contest Period.
License

Each of the Participants hereby irrevocably grants to Young Living and the other members of the Young Living Group an unrestricted, exclusive, royalty-free license to use all materials of whatever kind or nature created, produced or delivered by such Participant to Young Living in relation to the Contest including without limitation sound and/video recordings, statements, stories and photographs or other likeness, and in relation to any Winner, also materials such as post Contest interview such Winner for sharing of his/her success stories (all such materials collectively, the “Materials”) throughout the universe in perpetuity and to exploit all the rights in relation to the Materials and each and every part thereof, including all copyrights therein, all renewals and extensions of such copyrights, all similar rights, and all other performance, fixation, and exploitation rights of any kinds, nature or description in, to and with respect to the Material that may be secured under the laws now or hereafter in effect in Hong Kong or in any other jurisdictions (all such rights collectively, the “Rights”). To the fullest extent allowable under any applicable law, each of the Participants hereby irrevocably waives any and all moral rights of authors, author’s rights, personal rights, or similar rights (collectively referred to as the “Special Rights”) which such Participant may now or later have in the Material and any other works now or hereafter created containing the Material. To the extent, if any, that such waiver is invalid or unenforceable, such Participant covenants not to sue or otherwise enforce any of the Special Rights against Young Living or any member of the Young Living Group. To the extent, if any, that such covenant is not valid or is unenforceable, such Participant hereby grants to Young Living and all the other members of the Young Living Group the irrevocable, exclusive worldwide right and license to use, practice and exercise each and all of the Special Rights and in all respects to have rights as nearly identical to the rights of authorship and ownership as the law permits.

Without limiting the generality of the foregoing, each of the Participants hereby acknowledges and agrees that Young Living and/or any member of the Young Living Group shall have the unlimited and exclusive rights to do the following: to change, edit, add to, take form, adapt, reformat or reprocess the Material in any manner, in any medium, and for any reason; and to publish, reproduce, broadcast, distribute, or otherwise communicate the Material to the public (including without limitation in Young Living’s promotional channels such as Facebook, webpage or flyer), in whole or in part, with or without mentioning of such Participant’s name.

Without limiting the generality of the foregoing and for the avoidance of doubt, using of the Materials and exploiting of the Rights in any publicity or advertising carried out by Young Living or any of its related entities in any media shall be without any further compensation, notification or permission and without any territorial or time limitation, except where prohibited by the applicable laws. The Participants hereby expressly agree to release and forever discharge Young Living from any and all liability related to any dissemination of the Materials as aforesaid.
Personal Data

Young Living respects personal data privacy and is committed to implementing and complying with the data protection principles and all relevant provisions under the Personal Data (Privacy) Ordinance (Chapter 486 of the laws of Hong Kong) (the “Ordinance”). For the purpose of this section, “Young Living” will also be referred to as “we” or “us” and “our” shall be construed accordingly, and each of the Participants will also be referred to as “you” and “your” shall be construed accordingly.

To preserve the confidentiality of personal data provided by you as an individual to us, we maintain the following privacy principles:-
1. we only collect personal data that we believe to be relevant, adequate and required to conduct our business, and which we consider is not excessive;
2. save as notified herein, we will not disclose your personal data to external parties unless we have your consent or are required by law;
3. we maintain appropriate security systems to protect the security and confidentiality of your personal data; and
4. we permit only properly trained and authorized employees to access your personal data.
Without prejudice to the right that Young Living already has in relation to the collection, use, transfer and retention of the personal data collected from the Participants as a Member pursuant to the Agreement, each of the Participants hereby consent to the collection, use, transfer and retention of his/her personal data provided to Young Living in relation to the Contest which include name (English), Member number, email address and date of birth are collected and kept for the purposes of, and necessary for, processing such Participant’s registration, providing administrative support to such Participant, attending to all matters in relation to the purchase of the Slique® weight management collection by such Participant as a Member, administrating the Contest and related events, arranging delivery of the Prize(s), organizing interview of such Participant or related events of Young Living, producing Young Living’s publications or marketing materials, and all other purposes stated in these Rules, related or incidental to the above.

In relation to the personal data of another Member provided by you to Young Living, if any, you warrant that such other Member has consented to the transfer of his/her personal data to Young Living and the collection, use, transfer or retention of his/her personal data by Young Living for the purposes of the Contest as set out above or any directly related purposes.

Young Living is to retain personal data for no longer than is required to fulfill the purpose (or any directly related purpose) for which the data is or is to be used, subject to legal, statutory and regulatory requirements mandating the retention of data.

Young Living will disclose and transfer data it collected including personal data when required to do so by law, for example, in response to a court order or a law enforcement agency's request.

Young Living may disclose and transfer data it collected including personal data to third parties such as employees, related companies, including subsidiaries and associated companies within the Young Living Group, joint venture partners, agents, independent contractors, business associates and service providers, who may be located in or outside Hong Kong, as necessary for any of the purposes stated above. Where personal data is provided to third party organizations, the personal data will only be disclosed or transferred to such third parties that respects personal data privacy and are under a duty of confidentiality to Young Living.

You, in registering for the Contest and providing the data or the personal data as collected by us (as the case may be), agree to the use, retention, disclosure and transfer of your data or personal data (as the case may be) as aforesaid.
Limitations of Liability

Young Living and the other members of the Young Living Group, advertising and promotion agencies, printers, and judges involved in this Contest are not responsible for any inaccuracies in any information which may be used in the Contest, for any technical or human error which may occur in the processing of entries or results, including data entered by the Participants, any entry miscommunications such as technical failures related to computer, telephone, cable, and unavailable network or server connections, related technical failures, or other failures related to hardware, software, or virus, or incomplete, late, or misdirected entries. Any compromise to the fair and proper conduct of this Contest related to a computer virus or similar type of technical impairment that may affect the proper fairness, security, and administration of the Contest may result in the termination, amendment, or modification of the Contest or portion thereof at the sole discretion of Young Living. Young Living reserves the right, in its sole discretion, to void any entries of the Participants whom Young Living believes has attempted to tamper with or impair the administration, security or fairness of the Contest or breach any part of these Rules or who acts in a non-sportsman like manner or with the intent to threaten, harass or cause any nuisance or inconvenience to any other person.

By participating in the Contest, the Participants waive all rights to claim punitive, incidental and consequential damages, attorneys’ fees, or any damages arising from or in connection with participation in the Contest or acceptance, possession, and use of any award.

All causes of action arising out of or connected with this Contest or any award shall be resolved individually, without resort to any form of class action. Some jurisdictions may not allow certain limitations on damages or the ability to seek damages through a class action, so some of these restrictions may not apply to you.
Other Rules and Regulations

If any change in any aspect of the Prizes is beyond the control of Young Living, neither Young Living nor any other promotional partners furnishing the Prizes will be liable or responsible for any such changes and Young Living reserves the right to substitute a prize of equivalent or greater value (such value as solely determined by Young Living to have satisfied this condition), at Young Living's sole and absolute discretion, if, for any reason, all or any portion of a Prize, as described herein, are or become unavailable. No transfer of a Prize to a third party is permitted. By accepting a Prize, the Participants agree that Young Living shall not be liable for any injuries, damages, or losses of any kind resulting from or in connection with the awarding, acceptance, possession, or use of the Prize or any aspects or parts thereof.

Young Living will be the final arbiter of all rule interpretations and qualification determinations and such decisions will be final. Young Living reserves the right to suspend or terminate the Contest, without notice, for any reason or no reason, in its sole discretion. Employees of Young Living and its associated entities and their spouses and immediate family members are not eligible to participate in the Contest. The Contest is void where prohibited by law.

By participating in the Contest, each of the Participants (i) acknowledge compliance with these Rules including all eligibility requirements, (ii) warrant that any information he/she provide in connection with the Contest is true and accurate, (iii) agree to be bound by the decisions of Young Living which shall be final and binding in all matters relating to the Contest, in particular that Members who have not complied with these Rules are subject to disqualification; and (iv) any material produced by he/she to Young Living including the Materials shall not infringe the intellectual rights or any other rights of any third party whatsoever.

Each of the Participants shall indemnify, defend and hold Young Living and any other member of the Young Living Group harmless together with its and their respective directors, officers, employees, agents, representatives from and against any and all claims, actions, causes of action, liabilities, losses, damages, investigations, penalties, fees and costs (including reasonable attorneys’ fees) arising out of, directly or indirectly, from such Participant’s failure to comply with the terms and conditions of these Rules.

Young Living’s failure to or decision not to enforce any provision in these Rules will not constitute a waiver of that or any other provision of these Rules. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

These Rules contains all of the terms and conditions governing the subject matter hereof. No other representations, oral or otherwise, shall be deemed to exist or to bind Young Living. Without limiting the generality of the foregoing, in the event of any conflict between these Rules and other materials relating to the Contest (including, without limitation, any point of sale, online or print advertising), these Rules shall prevail.

The Participants may obtain a list of the Winners' names by sending a self-addressed postage stamped envelope to Young Living Slique in 60 Contest – Winners List c/o Young Living Hong Kong Limited, 6/F, The Wellington, 198 Wellington Street, Central, Hong Kong. The Winners list will be sent within a reasonable time after all the Prizes have been awarded.

This Contest is subject to all applicable laws in Hong Kong. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Participants and Young Living in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Hong Kong without regard to conflicts of law principles. All the Participants agree to submit to the jurisdictions the Hong Kong courts.
